In short

  • Degroshi is a personal finance tool run by Private Entrepreneur Koval Oleksii Andriiovych (Ukraine). It is in a pre-release state. The core features are free; optional paid plans are being introduced.
  • These Terms are a public offer. You accept them by creating an account. The Ukrainian text prevails over the English translation.
  • You must be at least 16 years old and keep your sign-in details safe.
  • Degroshi stores and organises the financial records you enter or connect. It does not hold money, make payments for you or give financial, investment, tax or legal advice.
  • A paid plan bought on the web renews automatically and is charged until you cancel. If you live in Ukraine you pay us through monobank; if you live anywhere else you buy from our reseller Paddle, the Merchant of Record for those orders. You can cancel any time; the plan stays active until the end of the paid period. The first payment through monobank can be refunded in full within 14 days; Paddle purchases are refunded under Paddle's Refund Policy. Plans bought in the App Store follow Apple's terms.
  • AI features (the "Suricate" assistant, drafts, receipt reading, categorisation) make proposals. Nothing is saved until you confirm it. AI processing takes place in the United States, with the safeguards described in the Privacy Policy.
  • Connections to Monobank, crypto wallets and exchanges are read-only. Their own terms apply to you too.
  • In shared spaces you are responsible for whom you invite and what you share.
  • Ukrainian law governs these Terms. If you live in the EU, the consumer protections of your country still apply.

1. Who we are and what these terms cover

These Terms of Service (the "Terms") are a contract between you and Private Entrepreneur Koval Oleksii Andriiovych (ФОП Коваль Олексій Андрійович; "PE Koval", "we", "us"), registered in Ukraine, RNOKPP 3651501498, entered in the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Organisations of Ukraine on 8 December 2021, record No. 2010350000000093426. Place of registration: Chervone, Mykolaiv Oblast, Ukraine. Contact: support@degroshi.com, +380 68 698 94 32.

They cover the Degroshi service (the "Service"): the web app at degroshi.com, the Degroshi apps for iPhone and Mac (the "apps", including beta versions distributed through TestFlight), the API at api.degroshi.com and everything we provide through them, including paid plans.

These documents are part of the Terms:

  • Privacy Policy
  • Cookie Policy
  • AI Terms and Disclosure
  • Acceptable Use Policy
  • Connected Services Notice

If these Terms and one of those documents disagree, the more specific document wins for its own subject.

How the contract is concluded. These Terms are a public offer to conclude a contract on the conditions set out here, on equal terms for everyone (Articles 633, 634 and 641 of the Civil Code of Ukraine). You accept the offer when you create an account: the contract is then concluded in electronic form under the Law of Ukraine "On Electronic Commerce". A paid plan is added to that contract when you confirm a purchase (section 5). If you do not accept these Terms, do not use the Service.

2. Eligibility

  • You must be at least 16 years old.
  • You must have the legal capacity to enter into a contract. If you are 16 or 17, you may buy a paid plan only with the consent of a parent or guardian, or with money you earn or otherwise receive yourself (Article 32 of the Civil Code of Ukraine). To buy a paid plan you must also be allowed to use the payment card, other payment method or store account you pay with.
  • If you use the Service for a household, family or other group, you are responsible for complying with these Terms when you act on their behalf.
  • The Service is offered to consumers. If you use it for business purposes (for example to track the accounts of your private entrepreneurship), the consumer protections described below may not apply to you.

3. Your account

Creating an account. You can sign up with an email address and password, or with Google or Apple sign-in. We verify your email address before the account becomes active. Your name and email address must be accurate.

Security. You are responsible for everything that happens under your account. Keep your password, one-time codes and any API keys you create confidential. Use a password of at least 8 characters that you do not use elsewhere. Tell us at support@degroshi.com as soon as you suspect unauthorised access.

Sessions. Browser sessions last up to 7 days and sessions in the apps up to 60 days; both are extended while you use the Service. You can sign out of any device from the app.

API keys and external AI clients. You may create API keys and authorise external tools (for example an AI chat client that supports our connector) to access your data. Anything done with those credentials counts as done by you. What an external tool reads from Degroshi goes to that tool and its provider, under your own agreement with them. Revoke a key or an authorisation as soon as you no longer need it.

One person, one account. Do not share an account with anyone. Use a shared space instead (section 9).

4. Plans and pre-release status

The Service has a free plan ("Free") and optional paid plans: "Plus" for one person, "Family" for up to five people, and "Business", which adds one business space for a sole proprietor (ФОП) to what Plus includes. The business space opens with its beta; until then Business gives what Plus gives. Section 5 explains how paid plans are bought, renewed, changed, cancelled and refunded.

Each plan's limits (for example how many spaces, people, bank connections, wallets and exchanges, Suricate messages and receipt photos it includes, and how much room for files) and its price are listed on the Pricing page, and the current offer is shown on the Plan & billing page on the web and on the plan screen in the apps before you buy. The limits apply to every plan, including the free plan, which stays free. If we ever reduce what a plan includes, we tell you in advance, in the app or by email (for a paid plan during a period you have paid for, at least 30 days ahead: see section 5.8).

If you are over a limit (for example after moving to a lower plan or back to the free plan), nothing you already have is deleted or switched off: your records, files, spaces and connections stay and keep working. You just can't add more of what is over the limit until you are within it again or choose a higher plan.

The Service is in a pre-release state: features change often, some may be incomplete, and data formats may change. Nothing starts costing money without your explicit agreement: a paid plan starts only when you buy it.

5. Subscriptions and payments

5.1 Where you can buy a plan

  • On the web, if you live in Ukraine, on the Plan & billing page. You confirm at checkout that you live in Ukraine (where you live, not where you happen to be when you pay) and pay us on the secure payment page of monobank (JSC "Universal Bank", Ukraine) by card, Apple Pay or Google Pay. Card details are entered on monobank's page; we never see or store your full card number or security code.
  • On the web, if you live anywhere else, on the Plan & billing page. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for these orders: Paddle sells the subscription to you, takes the payment (card, PayPal, Apple Pay, Google Pay or another method Paddle offers in your country), charges your country's sales tax, and handles payment questions and refunds under its Buyer Terms. Your contract for the purchase is with Paddle (Paddle.com Market Limited, England and Wales, for most countries); these Terms govern your use of the Service. Payment details are entered in Paddle's checkout; we never see them.
  • In the iPhone app, through the App Store. The purchase is made with Apple under Apple's terms; Apple charges you and handles renewal, cancellation and refunds for that purchase. We learn about the purchase from RevenueCat, our in-app purchase service, which identifies you only by your Degroshi account identifier.

A plan works on every device where you sign in with the same Degroshi account, wherever you bought it. To avoid paying twice, you cannot buy a plan on the web while a store subscription gives you a plan, and the app hides store purchases while a web subscription renews. If you still buy the same or a higher plan in the App Store while a web subscription renews, the web subscription stops renewing at the end of its paid period.

A plan you change, cancel or ask a refund for is managed where it is billed: web subscriptions on the Plan & billing page (for Paddle purchases also in Paddle's customer portal, linked there as "Card and invoices"), store subscriptions in the store's subscription settings.

5.2 Price and currency

  • The price, the billing period (a month or a year) and the renewal terms are shown before you pay. For monobank purchases the price shown is the total you pay: we add no fees or taxes on top of it.
  • monobank (Ukrainian residents): prices are in Ukrainian hryvnias (UAH) and charged in UAH.
  • Paddle (everyone else): prices are listed in US dollars (USD) and already include the sales tax (for example VAT) your country requires. Before you pay, Paddle's checkout shows the final price, in your local currency where Paddle offers it, with the tax it contains. Your card issuer may apply its own conversion or fees.
  • A web subscription keeps the price it was bought at for every renewal: the same amount in UAH through monobank, the same price in USD through Paddle (Paddle's receipt for each payment shows the amount in your currency and the tax). If we change the price of a plan, the new price applies to new subscriptions.
  • For each monobank payment you can download monobank's payment receipt and an invoice from Degroshi on the Plan & billing page, and a fiscal receipt when one is issued for the payment. For Paddle purchases, Paddle emails you a receipt with its invoice, which you can also download on the Plan & billing page or in Paddle's customer portal. App Store purchases are receipted by Apple.

5.3 Automatic renewal

A web subscription renews automatically at the end of each paid period, for the same period, plan and price, until you cancel it. At checkout you agree that the price is charged every month or every year until you cancel (by Degroshi through monobank, or by Paddle for Paddle purchases); we record when you gave that consent and the version of these Terms you accepted.

monobank: when you pay the first time, monobank saves your card as a token for future payments. On the renewal date we charge the saved card ourselves, through monobank, without asking you again. A monthly period is counted from the day you paid; if that day does not exist in a shorter month, the subscription renews on that month's last day (for example 31 January, 28 February, 31 March).

Paddle: Paddle keeps your payment method and charges each renewal under its Buyer Terms, and emails you about it.

You can see the next charge date and amount on the Plan & billing page at any time.

5.4 Cancelling

  • Web: cancel at any time on the Plan & billing page (a Paddle purchase can also be cancelled in Paddle's customer portal or from the link in Paddle's emails). There will be no further charges. Your plan stays active until the end of the period you have paid for, then you move to the free plan. Until then you can resume the subscription on the same page. When a monobank subscription ends, the saved card is no longer charged: we ask monobank to delete it and wipe our encrypted copy of the card token.
  • App Store: cancel in your Apple account's subscription settings (the app links to them). Deleting your Degroshi account does not cancel an App Store subscription; Apple keeps charging until you cancel it there.
  • Deleting your Degroshi account cancels a web subscription: there are no further charges, and the plan ends with the account.

5.5 Upgrades and downgrades

Upgrading (to a higher plan, or to the same plan for a longer period) applies immediately, with the unused part of your current paid period credited. The credit is the share of the period that is left multiplied by the price you paid.

  • For the same billing period length (for example monthly to monthly), you pay now the difference between the two prices for the rest of the current period, and your renewal date stays the same.
  • For a longer period (monthly to yearly), you pay now the new price minus the credit, and a new period starts on that day.
  • The app shows the amount due, the credit and the next charge before you confirm.
  • monobank purchases: we charge the saved card (your bank may ask you to confirm the payment), or send you to a payment page. If the amount due is less than 1 UAH, the change is free.
  • Paddle purchases: Paddle calculates the credit and the amount due to the minute, in your currency with tax, and charges your saved payment method when you confirm. If the payment is declined, your plan stays as it was.

Downgrading (to a lower plan, or to a shorter period) applies at the next renewal. Nothing is charged or refunded now; you keep your current plan until then, and you can drop the scheduled change before it applies.

App Store: Apple applies its own rules: an upgrade within the subscription group takes effect immediately and Apple refunds the unused part of the old subscription pro rata; a downgrade takes effect at the next renewal.

5.6 Failed payments

If a renewal charge fails (for example the card is declined, the bank asks for a confirmation that we cannot get without you, or the saved card is no longer available):

  • your plan stays active for 3 days after the end of the paid period (grace period);
  • monobank: we try to charge the card again 1, 3 and 7 days after the failed charge, and you can pay at any time with Pay now on the Plan & billing page, which also lets you use another card;
  • Paddle: Paddle retries the payment over up to 30 days and emails you, and Pay now opens Paddle's page to change your payment method;
  • after the grace period the paid features pause until a payment succeeds; if the last retry (ours, or Paddle's) fails, the subscription ends and you move to the free plan.

App Store subscriptions follow Apple's billing grace period and retry rules.

5.7 Refunds and your right of withdrawal

The Refund Policy sums this section up.

  • First payment, 14 days. You can withdraw from a web subscription bought through monobank and get a full refund of its first payment within 14 days of buying it, without giving a reason. To do so, use the "Withdraw from the contract" button on the Plan & billing page, or tell us by email to support@degroshi.com from the address on your account; any clear statement is enough, and you may use the model form below. We refund the payment to the card you used within 14 days of receiving your notice, and the subscription ends.
  • Your statutory right. Consumers in Ukraine and in the EU or EEA have a legal right to withdraw from a contract concluded at a distance within 14 days without giving a reason. The full refund of the first payment above is how we honour that right for web subscriptions bought through monobank, without deducting anything for the days you have already used. For Paddle purchases, Paddle, as the seller, honours that right under its Buyer Terms and Refund Policy. The "Withdraw from the contract" button works for those purchases too within the same 14 days: we pass your notice to Paddle, and Paddle refunds you. Ukrainian consumers keep all other rights that Ukrainian consumer protection law gives them.
  • Paddle purchases are refunded by Paddle, under its Refund Policy and your statutory rights. You can ask Paddle directly (paddle.net), or write to us within 14 days of buying and we will ask Paddle to refund the first payment. Paddle may also refund a payment at its discretion within 14 days of it.
  • Duplicate payments are refunded automatically to the card they came from, for example a second payment for a period that is already paid, or a charge for a subscription that had already ended or an account that had been deleted. A duplicate Paddle subscription (two checkouts paid at once) is cancelled and refunded automatically.
  • Renewals and upgrades are not refunded, except where the law requires it or where we charged you in error. Cancel before the renewal date to avoid the next charge.
  • Refunds are made in the currency you were charged in, through the provider you paid (monobank in UAH, or Paddle); it can take several business days for your bank to show the money back. If a payment for the current period is refunded in full or charged back, the paid plan ends.
  • App Store purchases can only be refunded by Apple, under Apple's policies (reportaproblem.apple.com). We cannot refund them.

Model withdrawal form (complete and send it only if you want to withdraw from the contract):

To PE Koval Oleksii Andriiovych, support@degroshi.com. I hereby give notice that I withdraw from my contract for the following service: Degroshi subscription (plan: …). Bought on: … Name: … Email address of the Degroshi account: … Date: …

5.8 Changes to plans and prices

  • We may change the plans we offer, what they include and their prices. A web subscription keeps renewing at the price it was bought at.
  • If we ever need to change the price of an existing web subscription, or reduce what a paid plan includes during a period you have paid for, we will tell you by email or in the app at least 30 days before the change applies. You can cancel before the change applies; if a reduction happens during a paid period, you can ask for a refund of the unused part of that period.
  • A plan marked as shared with space members (for example "Family") also applies to the members of the spaces you own, inside those spaces, for as long as your plan is active.
  • We may give plans without payment (for example to beta testers). Such a plan ends on the date we tell you, without any charge.

5.9 Recording your payment in Degroshi

After you subscribe, Suricate may offer to record the payment as an expense in your records and to add the renewals as a recurring payment. This is a proposal like any other AI proposal: nothing is recorded unless you approve it.

5.10 Payment records

We keep a record of every payment (amount, currency, for Paddle purchases the tax, date, plan, period and the masked card number) to provide receipts and invoices and to meet our tax and accounting obligations, also after you delete your account. The Privacy Policy explains what we keep and for how long.

6. What the Service does and does not do

Degroshi lets you record and organise personal finances: accounts, balances, transactions, transfers, budgets, recurring payments, categories, receipts and notes, in several currencies, alone or with the people you share a space with. It can also read data from services you connect (section 8), help you with AI features (section 7), and keep you informed with in-app notifications and service emails (for example budget alerts and weekly summaries), which you can turn off in the notification settings.

The Service is not:

  • Financial, investment, tax or legal advice. Figures, forecasts, categories, suggestions and assistant answers are generated from the data you give us and from automated rules and models. They can be incomplete or wrong. Check them before you rely on them, and talk to a qualified professional for decisions that matter.
  • A bank, payment service, e-money service, broker or custodian. We never hold, move or have access to your money or crypto assets. We cannot make payments, transfers, trades or withdrawals for you. The only payments we take, directly or through our reseller Paddle, are the fees for your own plan (section 5).
  • An accounting or tax-filing tool, today. Reports are for your own information. The business features described in section 10 are not available yet.

Exchange rates in personal spaces come from third-party data providers and may differ from the rates your bank or exchange applies.

7. AI features

The Service includes features built on third-party AI models: the "Suricate" assistant, drafts created from text or voice, receipt reading, category suggestions, import help and recurring-payment detection. The AI Terms and Disclosure explain how they work. The key points:

  • Proposals, not actions. AI output is a proposal. Nothing is written to your records until you confirm it in the app.
  • You know it is AI. Suricate is an AI system, not a person, and the app says so.
  • Scope. The assistant is designed to talk only about your money and about using the app. It will decline other topics.
  • Accuracy. AI output can be wrong. You are responsible for what you confirm.
  • Processing in the United States. The AI providers we use process data in the United States, with the safeguards described in the Privacy Policy (section 6).
  • Fair use. AI usage is limited per person and per space. The app shows your remaining allowance as a share of the limit.
  • Turning it off. A space owner can switch AI features off for the whole space.

8. Connected services

You may connect third-party services so that the Service can read data from them: your Monobank accounts (Degroshi is a registered Monobank provider; you confirm the access request in the Monobank app), crypto wallets (through the Zerion API, watch-only or verified with a wallet signature) and crypto exchanges (through read-only API keys). The Connected Services Notice describes each connection.

  • Every connection is read-only and is made at your request. We refuse exchange API keys that can trade or withdraw when the exchange reports a key's permissions; when it does not, you confirm that the key is read-only.
  • You must have the right to connect the account or wallet, and you must comply with the third party's own terms when you do.
  • Disconnecting in Degroshi deletes the credentials we hold. To withdraw the access at the other service as well, do it there (for Monobank, in the Monobank app).
  • Third-party services are not under our control. They can change, interrupt or stop their APIs, and the data they return may be delayed or incomplete.

9. Shared spaces

A space is a set of financial records that can be shared with other people. The owner invites members and assigns a role (owner, admin, member or viewer) and chooses which accounts each member can see.

  • You decide what you share. Before you invite someone or give them access to an account, make sure you may share that data with them, especially data about other people (for example a joint account).
  • Members see what you share. Anyone you give access to can see, and depending on their role change, the records in that space. We cannot undo what another member has already seen.
  • Members' data. When another member adds records to a shared space, those records belong to the space. If a member deletes their account, the records they created in a shared space are handed to the space owner so the others keep their data.
  • Owners. An owner is responsible for their space. If an owner deletes their account, the space is handed to the senior remaining admin or member; if nobody can take it over, the space and its data are deleted.

10. Business spaces (upcoming)

We are building business features: a separate Business space for Ukrainian private entrepreneurs (ФОП) and companies. They are not available yet. Before they launch we will add business terms to these Terms. What you should know now:

  • Not tax or accounting advice. Tax calculations, deadlines, books and returns will be prepared from your data and from published rules. They are tools, not individual tax, accounting or legal advice. You (or your accountant) remain responsible for checking them and for what you file and pay.
  • Nothing is filed for you. Returns will first be available as files (XML or PDF) that you check and submit yourself in the tax authority's electronic cabinet. Degroshi will never file a return or make a tax payment without your explicit action.
  • Official rates. In business spaces, foreign-currency operations will be valued at the official exchange rate of the National Bank of Ukraine for the legally relevant date, and that value will be kept with the operation. Personal spaces keep using current market rates.
  • Company bank accounts. Companies will be able to connect Monobank business accounts with a token issued in the monobank business cabinet (see the Connected Services Notice).
  • Other people's data. For data about employees, counterparties and clients that you enter in a business space, you will be responsible as the controller under data protection law, and we will process it on your behalf under a data processing agreement.
  • Business plans will be paid plans under section 5.

11. Your content

Ownership. You keep all rights to the data you enter, upload or connect (your "Content"): transactions, notes, receipts, voice clips, chat messages and so on.

Licence to us. So that we can run the Service, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, process, transmit, display and back up your Content, and to send the parts needed to the service providers listed in the Sub-processors list, for the sole purpose of providing the Service to you. This licence ends when you delete the Content or your account, except for copies that remain in backups for a limited time (see the Privacy Policy) and for records we must keep by law.

Your promises. You promise that you have the right to give us this licence and that your Content does not break the law or anyone's rights.

AI output. You may use the output the AI features produce for you. We make no claim to it. Because similar inputs can produce similar output for other people, AI output is not exclusive to you.

12. Our intellectual property

The Service, including its software, design, name, mascot and documentation, belongs to PE Koval or its licensors. We give you a personal, non-transferable, revocable licence to use the Service as these Terms allow. You may not copy, modify, sell, rent, reverse-engineer or create derivative works of the Service, except where the law lets you.

Feedback you send us may be used without any obligation to you.

13. Acceptable use

The Acceptable Use Policy lists what is not allowed. In short: no unlawful use, no abuse of other people or of the Service, no circumventing limits or AI safeguards, no automated scraping, and no sharing of other people's data without the right to do so.

14. Availability and changes

We work to keep the Service available, but it is provided without an uptime guarantee. We may interrupt it for maintenance, security or technical reasons, and we may change, add or remove features. If we remove a feature that matters to your stored data, we will try to give you reasonable notice and a way to keep that data.

We also release updates to the apps. An app may require an update before it keeps working with the Service.

15. Suspension and termination

By you. You can stop using the Service at any time and delete your account in the settings, on the web or in the apps. Deletion is permanent and cancels a web subscription; an App Store subscription must be cancelled with Apple (section 5.4). The Privacy Policy explains what is deleted and when.

By us. We may suspend or close your account, with notice where reasonably possible, if you seriously or repeatedly break these Terms, if the law requires it, or if continuing would harm the Service or other people. Where it is safe to do so, we will give you a chance to fix the problem first. If we close your account for a reason that is not your breach of these Terms, we refund the unused part of a paid web subscription.

End of the Service. If we stop providing the Service as a whole, we will give at least 30 days' notice and a way to get your data out, stop all renewals, and refund the unused part of any paid web period.

16. Disclaimers

The Service is provided "as is" and "as available". To the extent the law allows, we make no promises about the accuracy, completeness or fitness of the Service, its reports or its AI output for a particular purpose.

Nothing in these Terms limits the rights that consumers have under the Law of Ukraine "On Protection of Consumer Rights" or, for EU residents, under the mandatory consumer laws of their country of residence. If you pay for a plan, the Service you pay for must match these Terms, and your statutory remedies if it does not (for EU consumers, under Directive (EU) 2019/770 on digital content and digital services) are not affected.

17. Liability

To the extent the law allows:

  • We are not liable for losses caused by decisions you make based on the Service, including its reports, suggestions or AI output.
  • We are not liable for losses caused by third-party services (banks, payment providers, app stores, exchanges, wallet providers, AI providers, hosting providers) or by events outside our reasonable control.
  • We are not liable for indirect losses, loss of profit or loss of data that you could have prevented with a reasonable backup, or for what other members of a shared space do with the data you shared.
  • Our total liability for all claims under these Terms is limited to the fees you paid for the Service, directly, through Paddle or through an app store, in the 12 months before the event that gave rise to the claim.

We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, for intent or gross negligence, or for anything else that cannot be excluded by law, and nothing in this section limits your rights as a consumer. The limits in this section apply only as far as consumer protection law allows them (for consumers in Ukraine, the Law of Ukraine "On Protection of Consumer Rights"; for consumers in the EU, the law of your country of residence).

18. Governing law and disputes

These Terms are governed by the law of Ukraine.

If you are a consumer living in the European Union or the European Economic Area, you also keep the protection of the mandatory consumer-protection rules of the country where you live, and you may bring claims before the courts or consumer bodies that those rules make available to you.

Please contact us first at support@degroshi.com; most problems can be solved directly. Consumers in Ukraine may also turn to the State Service of Ukraine on Food Safety and Consumer Protection (dsp.gov.ua); consumers in the EU may turn to the consumer authority or consumer centre of their country. We do not take part in dispute resolution before a consumer arbitration body. Otherwise disputes are resolved by the competent courts of Ukraine, unless a mandatory law gives you the right to another forum.

19. Changes to these Terms

We may update these Terms. We will notify you of changes by email or in the app, and they take effect 3 days after the notice. If a change materially reduces your rights or what a paid plan gives you, we will tell you at least 30 days before it applies, and you may end the contract free of charge and get back the unused part of what you paid, within 30 days after the notice or after the change, whichever is later. If you keep using the Service after a change takes effect, the new Terms apply. If you do not agree, cancel any paid subscription and delete your account before the changes take effect. Changes to the price of an existing subscription follow section 5.8. The version and date at the top of this page show the current Terms.

20. Other terms

  • Entire agreement. These Terms and the documents listed in section 1 are the whole agreement between you and us about the Service. For purchases through Paddle, Paddle's Buyer Terms also apply between you and Paddle; for App Store purchases, Apple's terms apply between you and Apple.
  • Severability. If a part of these Terms is found invalid, the rest still applies.
  • No waiver. If we do not enforce a provision, we can still enforce it later.
  • Assignment. You may not transfer your account or this agreement to anyone else. We may transfer this agreement to a successor that takes over the Service; we will notify you if that happens.
  • Language. These Terms and the other documents at degroshi.com/legal are published in Ukrainian and English. The Ukrainian text is the original and prevails if the two differ. If a difference between them makes a term unclear, it is interpreted in your favour as a consumer.
  • Keeping a copy. You can save or print this page at any time. On request we send you the version of these Terms you accepted.

21. Apps distributed through the App Store

If you downloaded an app from Apple's App Store, the following also applies:

  • These Terms are between you and us, not Apple. We, not Apple, are solely responsible for the app and its content.
  • Your licence to use the app is limited to Apple-branded devices that you own or control, as the Usage Rules in Apple's Media Services Terms and Conditions allow.
  • Apple has no obligation to provide maintenance or support for the app. Contact us instead.
  • If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the extent the law allows, Apple has no other warranty obligation for the app; any other claims, losses or costs from such a failure are our responsibility as far as these Terms and the law make us responsible.
  • We, not Apple, are responsible for addressing any claims by you or a third party about the app or your possession and use of it, including product liability claims, claims that the app does not comply with legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
  • If a third party claims that the app or your possession and use of it infringes its intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
  • You confirm that you are not located in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
  • You must comply with any third-party terms that apply when you use the app (for example your mobile carrier's terms).
  • Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.
